| heal.abstract | Το Σύνταγμα, ως ανώτατος νόμος της Πολιτείας, περιέχει συναφείς διατάξεις αυξημένης τυπικής ισχύος, από το κανονιστικό περιεχόμενο των οποίων απορρέουν, κατά τρόπο μη καθολικό και απόλυτο, ορισμένες αξιολογήσεις επί του τραγικού και συνάμα υπαρξιακού ζητήματος της ευθανασίας. Οι συνταγματικές διατάξεις που πρέπει να αποτελέσουν το συναφές πλέγμα, είναι κυρίως τα άρθρα του Συντάγματος: 5 παρ. 1, σε συνδυασμό με το 25 παρ. 1, όπου προστατεύεται η Ζωή του ανθρώπου, ως «προσώπου» κοινωνικά καθορισμένου, 2 παρ. 1, όπου κατοχυρώνεται η Αξία του ανθρώπου, ως υπέρτατο συνταγματικά αγαθό και συνεπώς τα κρατικά όργανα οφείλουν να την προστατεύουν σε κάθε περίπτωση, και 5 παρ. 2, όπου το Δικαίωμα της ζωής αναγορεύεται σε δικαίωμα συνταγματικής περιωπής. Επίσης, στο πλαίσιο της ερμηνευτικής προσέγγισης των ως άνω διατάξεων, θα εξεταστούν και διεξοδικά θα αναλυθούν, στο μέτρο του δυνατού, τα επιμέρους ζητήματα, τα οποία συνιστούν αντικείμενο της ισχύουσας νομοθεσίας, ιδίως στον Ποινικό Κώδικα (όπως π.χ. ενεργητική και παθητική ευθανασία). Εν κατακλείδι, αυτό που ιδιαιτέρως πρέπει να μας απασχολήσει, είναι το εάν και κατά πόσο μπορεί, εκ των ως άνω, να συνταχθεί ερμηνευτικά, εκ του Συντάγματος, το δικαίωμα στο θάνατο με τη μορφή του ευ-θανάτου. | el |
| heal.abstract | The Constitution, as the supreme law of the State, contains relevant provisions of increased formal force, from the normative content of which derive, in a non-universal and absolute manner, certain evaluations on the tragic and at the same time existential issue of euthanasia. The constitutional provisions that must form the relevant network are mainly the articles of the Constitution: 5 par. 1, in conjunction with 25 par. 1, where Human Life is protected, as a socially defined "person", 2 par. 1, where the Value of Man is enshrined as a supreme constitutional good and therefore the state institutions must protect it in any case, and 5 par. 2, where the right to Life is recognized as a right to constitutional protection. Also, in the context of the interpretative approach of the above provisions, the individual issues, which are the subject of the current legislation, especially in the Criminal Code, will be examined and thoroughly analyzed, as far as possible (such as active and passive euthanasia). In conclusion, what should particularly concern us is whether and to what extent, from the above, the right to death in the form of euthanasia can be drawn up interpretatively, from the Constitution. | en |
